AI Training Use Restriction Checklist for Client Work

What this is for

Use this resource when a client commissions visual work and there is a risk that delivered images, source files, campaign assets, or unused selects could later be used to train AI systems, build datasets, or generate derivative images.

Why this matters

A client may commission images for one campaign, then later use those images as training material, reference material, dataset input, or prompt guidance for another AI-generated campaign.

  • The original campaign use may be limited
  • AI training may create future value from the work
  • Future synthetic campaigns may replace later commissions
  • Standard usage language may not address AI training

Questions to ask before delivery

Clarify whether commissioned work can be uploaded, analyzed, reused, trained on, or used to generate future visual material.

  • Can the client upload final images to AI tools?
  • Can the client use the work to train an internal AI model?
  • Can the client include the work in a dataset?
  • Does AI training require separate written permission?

What a restriction should cover

A useful restriction should cover more than formal model training.

  • AI model training
  • Dataset creation or inclusion
  • Synthetic derivative campaign assets
  • Internal AI systems
  • Third-party AI platforms
  • Future campaign reuse beyond the original license
